REQUEST FOR PROPOSALS (RFP) FOR LEGAL RETAINERSHIP SERVICES
1. Introduction
The Malawi School of Government (MSG) was formed by an Act Number 33 of Parliament through a merger of Malawi Institute of Management (MIM) and Staff Development Institute (SDI). The Mandate for the Malawi School of Government is to develop and deliver human resource development programmes and build capacity of the public and private sector.
The Malawi School of Government currently has two campuses in Mpemba, Blantyre and Kanengo, in Lilongwe in addition to the corporate office which is also located in Lilongwe.
The Malawi School of Government is inviting interested law firms and / or individuals with a minimum of ten (10) years post admission experience to submit written proposals to provide Legal Retainership Services to the School. As the School’s retained lawyers, the selected law firm / individual will be expected to provide a wide range of legal services.
2. Request for Proposals
MSG seeks Technical and Financial Proposals from reputable law firms and / or qualified lawyers for this appointment. Interested firms / individuals must provide information indicating that they are qualified to perform the required services and the information may include the firm’s / individual profile including general qualifications of partners, at least three references from other clients, descriptions of similar assignments undertaken, experience in similar conditions and availability of relevant and appropriate skills and expected legal fees.
The prospective law firms / individuals must have depth and specialist understanding on variety of the school’s regulatory issues. Relevant expertise should include but not limited to the following:
- Knowledge & experience with regulatory issues/matters
- Commercial Law
- Constitutional & Administrative Law
- International Law
- Employment & Labour Law
- Drafting and conveyancing
3. Specific Objectives
The legal firm/individual will be available to provide legal services to the school in litigation. The Institution will thus specify in each case work to be undertaken through issuance of an approved Task Order. The following work is anticipated:
- Litigation (criminal and civil)
- Drafting
- Conveyancing
- Legal Research
- Advising on the enforcement of the law, regulations, and directives
- Arbitration and mediation over clients disputes on behalf of MSG
- General legal advice
- All other tasks to be assigned by the client from time to time for the carrying out of MSG’s responsibilities.
4. Terms of Reference (TOR)

5. Selection
The prospective firm / individual will be selected in accordance with the Quality Based Selection (QBS) procedures as set out in the Government of Malawi Procurement Guidelines: “Request for Proposals Document for the Procurement of Consultancy Services”
6. Duration
The duration will be for a performance based renewable period of one (1) year from the effective date of the retainer.
7. Proposal Submission
Completed copies of proposals in sealed envelopes clearly marked “PROPOSAL FOR LEGAL RETAINER SERVICES” should be submitted in two separate envelopes one marked Technical Proposal for Legal Retainer Services and the other one marked Financial Proposal for Legal Retainer Services and must be delivered to Malawi School of Government at the address indicated below by 14:00 hours on 18th October, 2024.
