REQUEST FOR EXPRESSION OF INTEREST
CONSULTING SERVICES – LEGAL SERVICE IN TERMINATION OF CONTRACTS

1. The Government of Malawi through the Ministry of Education contracted various contractors to construct urban primary schools, Laboratories and Libraries as well as Girls Hostels in selected community day secondary schools across the country. These contracts were signed as back as 2016/2017 fiscal years. Some of these contracts have been extended continuously due to different reasons.

2. The Ministry wishes to terminate the contracts that have overstayed and have proved to create constant challenges to manage to the detriment of the government.

3. The Ministry of Education invites suitably qualified consulting legal firms to aid in terminating these contracts. Interested Consultants should provide information demonstrating that they have the required qualifications and relevant experience to provide the services.

4. Qualification on the field of assignment
The assignment is expected to be conducted by a firm that has the following minimum requirements;

A. The firm
It must be a multidisciplinary firm which is (or its lawyers) are on the list of lawyers which the Public Procurement and Disposable of Assets (PPDA) approved for the office of the Attorney General to engage.

The firm must demonstrate proven record of utmost integrity and ethical conduct.

The firm must have operated for at-least 10 years post registration.

Firms located or having offices or having a contact person in Lilongwe will have an added advantage.

B. Lawyers in the Firm
The firm must have at least one Partner that possess a Masters degree in commercial law, business law, business management, project management, general management, field works or any other relevant field.

The lead lawyer must have at-least 10 years experience in the legal field; and or the combined experience of two partners must be at-least 16 years.

At least two lawyers must have valid Practicing licenses verifiable with the Malawi Law Society.

The firm must have a clean record and must not have any subsisting issues related to corruption or mis-procurement.

5. All the firms should be eligible by showing their legal status in accordance with Malawian laws and regulations such as:

a. Registrar of Companies/ Business Certificate
b. Tax Clearance Certificate for the last ending year
c. Auditors Certificate for the last ending year
d. Valid Practicing Licenses for at least 2 lawyers
e. Core business and years in business

The consultant should provide traceable references of past clients for which similar services have been provided. Experience related to government entities and companies should be prioritized. The information shall include addresses, contact numbers and persons and email address.

6. Bidders must submit one ‘Original’ and “Two (2)” copies of the Expression of Interest
